الملخص
The purpose of the thesis is to study the use of technology as a medium for adjudication and arbitration of construction-related disputes in the UAE, taking into consideration the new Arbitration law of 2018 in the UAE.Thus the focus is on the use of technology, namely Online Dispute Resolution (ODR) in construction-related disputes. To achieve the research purpose, the researcher carries out a thorough review of the literature relating to alternative dispute resolution processes and technology adoption. The research develops an understanding of how the introduction and use of technology in the construction dispute resolution process is perceived. A qualitative approach is adopted to collect data in order to correlate the underlying research theories Technology Adoption and Distributive Justice. 22 structured interviews were conducted, each consisting of 39 questions. The interview covered the following topics ODR from a legal point of view, ODR and technology acceptance and ODR and justice.The respondents chosen were those individuals who are professionally interested in Alternative Dispute Resolution solutions to engineering contracts disputes. The main outcomes of this research is that Online Dispute Resolution is perceived useful and easy to use. The research results demonstrates that there is a will towards the use of ODR in construction disputes and even on a personal level, and the perceived outcomes of the ODR process will be fair, however, the research conludes that there is still fear in adopting ODR mechanisms on a larger scale. This is primarily due to the public lack of awareness on ODR mechnisims. Moreover, this research studies the inevitable adoption of technology that will ultimately influence the construction industry and those associated with it.
